Rhode Island Businesses: Understand Your E-Waste Responsibilities

Rhode Island treats business electronics differently from household electronics, and the difference catches a lot of companies out.

The state’s manufacturer-financed take-back program, created under the Electronic Waste Prevention, Reuse and Recycling Act (R.I.G.L. Chapter 23-24.10), covers households and K-12 schools. It does not cover businesses. Commercial generators have to make their own arrangements for retired equipment and manage it under the applicable hazardous or universal waste rules.

At the same time, covered electronics — televisions, monitors, CPUs, laptops and similar devices — have been banned from disposal at the Central Landfill since February 1, 2009. A business can neither throw them out nor hand them to the state program.

Separately, Rhode Island’s Identity Theft Protection Act of 2015 requires personal information to be destroyed in a secure manner, expressly including shredding, pulverization, incineration or erasure, once it is no longer reasonably needed (R.I. Gen. Laws § 11-49.3-2). That obligation follows the data onto the drives inside the equipment you are retiring.

Businesses with 50 or more employees also fall under Rhode Island’s commercial recycling rules and file annual recycling reports with RIDEM.

FAQ - Rhode Island

Why is computer and electronics recycling important in Rhode Island?

What electronics are banned from disposal in Rhode Island landfills?

Covered electronic products — televisions, computer monitors, CPUs, laptops and similar devices with screens over nine inches — have been banned from disposal at the Central Landfill since February 1, 2009. Putting them in a dumpster is not a legal option for a Rhode Island business.

Does Rhode Island’s state e-waste program cover my business?

No, and this is the point most companies miss. The manufacturer-financed program created by the Electronic Waste Prevention, Reuse and Recycling Act covers households and K-12 schools only. Businesses are excluded and must arrange their own disposal, which is exactly what we do.

What does Rhode Island law require for destroying data?

The Identity Theft Protection Act of 2015 (R.I. Gen. Laws § 11-49.3-2) requires that personal information be destroyed in a secure manner, naming shredding, pulverization, incineration and erasure, once it is no longer reasonably needed. Deleting files or reformatting a drive does not meet that bar. Our hard drive and media shredding does, and comes with documentation.

What happens to my electronics after recycling?

We follow a reuse-first approach: usable equipment is tested and resold wherever possible, which is what funds our buy-back pricing. What data destruction methods do you use?

Secure overwriting or physical shredding, matched to the media type and following NIST SP 800-88. Solid state and flash media are physically destroyed rather than degaussed, because magnetic erasure does not work on flash.

Do you offer on-site hard drive shredding in Rhode Island?

Yes. Our mobile shredding truck comes to your Rhode Island facility, destroys the drives while your staff watch, and the serial report is generated and printed before we leave.
